Roger Stone Won’t Be Getting A New Trial

(PoliticalLookout.Com)- Roger Stone and his lawyers tried to get a new trial, but they were not successful.
On Thursday, his motion for a new trial based on jury bias was denied by U.S. District Court Judge Amy Berman Jackson. Stone’s lawyers had said a jury forewoman who had strong opinions on President Donald Trump — a long-time friend of Stone’s — and therefore had bias against Stone.
Jackson called Stone’s request for a new trial “a tower of indignation, but at the end of the day, there is little of substance holding it up.”
Stone had argued the forewoman’s bias against Trump disqualified her from making a judgment of innocence or guilt regarding Stone. Stone’s lawyers presented social media posts from the forewoman to use as evidence in their claim.
Jackson shot down Stone’s claims that the forewoman lied about her opinions during the initial bias screening in the trial, In her ruling, she said:
“In the absence of any explicit statements of opinion about Stone, the defense casts its arguments about bias in terms of some sort of blend of ‘anti-Stone and anti-Trump sentiment.’ But linking them together in a sentence does not make them one and the same; there is zero evidence of ‘explicit bias’ against Stone, and defendant’s attempts to gain a new trial based on implied or inferred bias fail.
“The assumption underlying the motion — that one can infer from the juror’s opinions about the president that she could not fairly consider the evidence against the defendant — is not supported by any facts or data, and it is contrary to controlling legal precedent.”
She even chastised Stone’s lawyers, saying there weren’t “diligent” enough to do research on their own when the trial started, when information about the forewoman’s presence on social media was “a few mouse clicks away.”
That was in reference to the fact that the forewoman’s comments surfaced after the prosecutors in the case withdrew in early February following their initial sentencing recommendation, which the Justice Department chastised.
Stone’s lawyers presented these social media posts as evidence of bias. One included a re-tweet on January 30, 2019, which read:
“Roger Stone has y’all talking about reviewing use of force guidelines. Not Alton Sterling Not Eric Gardner Not Walter Scott Not Sandra Bland… But Roger Stone!! Think about that.”
Another was an Atlantic article she shared on Twitter on August 2 that had the title “We’re All Tired of Being Called Racists,” and that had the caption: “Then stop being racists. Co-signing and defending a racist and his racist rhetoric makes you a racist. Point blank.”
Stone was sentenced back in November to spend 40 months in prison as part of the fallout of Special Counsel Robert Mueller’s investigation into Russia interfering in the 2016 presidential election. He was convicted on seven counts of obstructing justice, which included lying to Congress about communicating with WikiLeaks.
Since he was denied a new trial by the U.S. District Court in Washington, D.C., it’s expected that he will now turn to an appeals court, hoping they will throw out his conviction altogether.
